The Canadian drug giant is seeking a $50 million settlement in federal court over a deal that has left it without a deal with Pfizer Inc., a drugmaker that is developing a new treatment for a common form of erectile dysfunction.
The settlement will be based on a $50 million payment by Pfizer, a Pfizer-led company, to Canadian drug company Allergan Inc., who had agreed to the deal.
The company, which also sells drugs for the same indication, said it will not sell or distribute any of the drug’s products after the deal is closed. The company had previously disclosed that Allergan had agreed to a one-year agreement to sell a generic version of Viagra, the active ingredient in Viagra, and Propecia, a generic version of the drug.
Pfizer also said it will pay $50 million to settle a suit brought by two former employees of Allergan, who had pleaded guilty to fraud and money laundering. Pfizer’s lawsuit sought to recover $50 million, including $2 million in damages, to resolve allegations that Allergan fraudulently and intentionally misrepresented the drug’s effectiveness and caused the deaths of five people.
The case is part of a multi-day trial of the alleged fraud, in which a jury in British Columbia, ordered Allergan and Allergan Inc. to pay $50 million to the plaintiffs, who filed the case on behalf of the defendants.
The trial was scheduled to begin in January, and plaintiffs had to file an initial pretrial statement with the federal judge to appear at the trial.
In the settlement, Pfizer said it agreed to pay $50 million to the plaintiffs and pay $25 million to the plaintiffs’ attorneys.
The federal judge, Amy Boudreau, rejected Allergan’s contention that it had “misunderstood the scope of its responsibility and responsibility as a business partner to Pfizer” and had not accepted the allegations of fraud.
The drug company said in a statement that Allergan’s payment would be the first in a series of settlements under the health care legislation that would allow Pfizer to avoid having to pay the plaintiffs the price of generic drugs. The suit is scheduled to be heard by U. S. District Judge Rebecca Doherty in the first week of this month.
The settlement, which was announced in part by Pfizer’s lawyers, will cover about $5 million of the $50 million settlement, which will be paid by Allergan in exchange for a promise not to sell the drug, or in the future.
“The settlement will provide the company with access to affordable, generic-drug companies,” said Marcia Angell, an industry analyst with Miller Tabak, a securities analyst in New York, and former president of the American Society for Reproductive Medicine. “We know that all of this is in the best interest of the patient, and we would like to be able to resolve this matter,” she added.
The drugmaker said in a statement that it had “agreed to settle a class-action lawsuit filed against Allergan by two former employees of Allergan, a company that had agreed to sell and distribute the drug in exchange for a promise not to sell the drug.”
The company said it was “committed to the success of the litigation and will continue to work with the parties and with the courts” to reach an agreement on the settlement.
Under the terms of the agreement, the company will pay $50 million to all the plaintiffs and $25 million to the plaintiffs’ attorneys, who will pay the remaining $25 million.
The company has no plans to sell or distribute the drug without a deal. It will not be required to do so. As previously announced, the company would not pay the remaining $25 million in the settlement.
